The Alabama Supreme Court affirmed Friday that a Tuscaloosa pharmacy cannot recover insurance coverage for a $4.75 million judgment stemming from a medication compounding error that seriously injured a patient, ruling the pharmacy owner was responsible for understanding what his policy covered.
The court issued its decision Oct. 9 in a case involving OMS Pharmacy, which operated as The Pharmacy at Midtown, and Hannah D. Browne, who suffered belladonna poisoning in March 2013 after receiving medication that was 1,000 times stronger than prescribed, according to court documents.
