A Shelby County judge Wednesday gave the defendants in a lawsuit against Alabama Power more time to make their case why the utility shouldn’t be allowed to seize access to property in putting up a transmission line.
Circuit Judge Jonathan Spann granted a motion by Fenn Church and the other defendants in a lawsuit, delaying a hearing on the company’s right to condemn part of Church’s property.
